FlockSoft, Inc. ("FlockSoft," "we," "our," or "us") operates the FlockSoft platform, including our websites, SaaS products, APIs, and AI implementation services (collectively, the "Services"). 2. Information We Collect

We collect information you provide directly to us, information we collect automatically through your use of the Services, and information we receive from third parties.

Information you provide directly includes: name, email address, company name, job title, billing information, and any other information you choose to provide when you register for an account, contact us, or use our Services.

Information collected automatically includes: log data (IP addresses, browser type, pages visited, time and date of visits, referring URLs), usage data (features used, agent configurations, task executions, API calls), device information, and cookies and similar tracking technologies.

We may also receive information from third parties, such as identity verification services, payment processors, and analytics providers, subject to their privacy policies.

3. How We Use Your Information

We use the information we collect to provide, maintain, and improve our Services; process transactions and send you related information; send you technical notices, updates, security alerts, and administrative messages; respond to your comments and questions; and for other lawful purposes.

Specifically, we use your information to: (a) operate and administer the platform and your account; (b) process payments and prevent fraud; (c) communicate with you about your account and our Services; (d) monitor and analyze usage patterns and trends; (e) detect, investigate, and prevent security incidents; (f) comply with legal obligations; and (g) send marketing communications where you have given consent or where we have a legitimate interest.

We do not use your data or your customers' data to train our AI models without explicit written consent. Your data is your data.

4. Information Sharing and Disclosure

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

We may share your information with: (a) service providers who assist us in operating our platform (subject to confidentiality obligations); (b) business partners with your consent; (c) law enforcement or other authorities as required by law or to protect our rights; (d) a successor entity in connection with a merger, acquisition, or sale of assets, with advance notice to you.

We maintain a current list of sub-processors who may have access to customer data. This list is available to enterprise customers upon request. All sub-processors are bound by data processing agreements consistent with this Privacy Policy.

5. Data Security

FlockSoft implements industry-standard security measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include AES-256 encryption at rest, TLS 1.3 encryption in transit, SOC 2 Type II certified infrastructure, ISO 27001 certified information security management, role-based access controls, and annual third-party penetration testing.

Despite these measures, no security system is impenetrable. We cannot guarantee the absolute security of your information. In the event of a security breach that affects your personal information, we will notify you as required by applicable law.

6. Data Retention

We retain personal information for as long as necessary to provide our Services and fulfill the purposes described in this Privacy Policy, unless a longer retention period is required by law.

Account data is retained for the duration of your account and deleted within 90 days of account termination, except where we are required to retain it for legal, regulatory, or legitimate business purposes. Audit logs are retained for a minimum of 12 months to support security and compliance requirements.

You may request deletion of your personal information at any time, subject to our legal obligations to retain certain data.

For transfers from the European Economic Area, United Kingdom, or Switzerland, we rely on Standard Contractual Clauses and other appropriate safeguards as required by applicable law. A copy of our standard data processing agreement is available to enterprise customers upon request.

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy on our website and, where required by law, by providing you with direct notice. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.
